Man Shoots Perp with Perps gun in self-defense, charged with crime!
What happened to Self-defense? The world has obviously gone upside down, as anyone can tell from watching the news, the “mostly peaceful protests with fire in the background, or people defending themselves being charged with attempted murder.
Yet that is exactly what happened in the most gun-friendly of places, New York City. A 57-year-old parking attendant noticed that there was someone looking into cars in his lot, likely with the intent to steal them. So, the attendant did his job and questioned the perpetrator, who then produced a firearm, and pointed it at the attendant who then tried to take the gun from him. The lot attendant was then shot twice, once in the stomach and once in the ear, however, he wrestled the gun away from the perp and shot them WITH THEIR OWN GUN in the chest.
You would think that “Hey, self-defense, not a big deal.” Wrong. The 57-year-old is now being charged with attempted murder, assault, and criminal possession of a weapon for his actions. The criminal was charged with the same attempted murder, assault, and criminal possession but added in a burglary. How can this be our country? You have a guarantee of “Life, Liberty, and Pursuit of Happiness”, something that would be dramatically shortened on all of those if the lot attendant had not fought back and was killed.
Mind you this is the same NYC that charged a deli attendant with second-degree murder for defending himself from a robbery with a kitchen knife and was sent to Rikers Island Prison before public outrage was so great for the injustice that the police and district attorney decided that it was probably wise to drop the charges.
So where does that leave us, law-abiding citizens, that legally carry to protect our families, our friends, our property, or even innocent folks we don’t even know? How are we supposed to protect any of that if we have aggressive lawmakers that decide that even though the response time to the initial incident could be minutes to HOURS depending on where you are, you shouldn’t be allowed to protect yourself?
Well, if you are in NYC apparently you are screwed. First off, they had a massive blow dealt to them by the Supreme Court, saying their prevention of legal concealed carry was atrocious. Even so, the time, money, and pain to get a legal gun in NYC is extensive. Then if you do use a firearm (or any implement) in self-defense, you are now likely to be charged with a crime for lawful self-defense.
It’s so insane that even if you defend yourself like they advise (take martial arts, disarm them, etc.) and turn it on the attacker to ensure that the threat is not a threat anymore, you can go to jail. Let’s not even start with people advising to “buy a shotgun, and if you hear someone breaking in fire two blasts in the air”.
I have stated repeatedly that I am not a lawyer, and I can’t advise what you should do, that is a personal decision based on your risk level, and willingness to be a victim/defendant. I can tell you this just re-affirms that I am committed to making sure EVERY time I go out, I slap on my Original or High Ride Magnetic Holster so I can protect my family because I would rather be judged by 12 than carried by 6. My family is counting on me to protect them and come home at the end of the day, and I will do everything in my power to put the odds in my favor.
